			<content:encoded><![CDATA[<p>Recent research by RealtyTrac Year-End 2009 Foreclosure Market Report shows us that 3,957,643 foreclosure filings have been reported on 2,824,674 U.S. properties in the year of 2009. This also includes foreclosure auctions that were scheduled, default notices and bank repossessions.</p>
<p>That&#8217;s a twenty one percent increase in properties from numbers in data collected in 2008, and a one hundred and twenty percent increase in total properties from 2007. The report also revealed that one in forty five housing units, 2.21 percent, received at least one foreclosure filing during 2009, up from 2008&#8242;s 1.48 percent and 2007&#8242;s 1.03 percent.</p>
<p>Just in the month December, foreclosure filings were reported on 349,519 properties in December. That&#8217;s a fourteen percent jump from the previous month of November and a fifteen percent increase from 2008. Nevertheless, even though there was an increase in December, foreclosure activity in the fourth quarter of 2008 has decreased by seven percent.</p>
<p>Of all of the states in America, Nevada took the nation&#8217;s highest state foreclosure rate; more than ten percent of housing units received at least one foreclosure filing in 2009. This is Nevada&#8217;s third consecutive year at the top of the foreclosure list. Nevada&#8217;s foreclosure activity in the month of December increased twenty seven percent from the previous month, however it still was down by twenty two percent from December of 08.</p>
<p>Arizona claimed the nation&#8217;s second highest state foreclosure rate in 2009 with more than six percent of properties receiving at least one foreclosure filing during 2009, and Florida claimed the nation&#8217;s third highest foreclosure rate at 5.93 percent of its properties getting at least one foreclosure during the filing year.</p>
<p>This raises things to think about in the debt collection industry. Trends that have recently been noted that debtors are maxing out their credit debt and low balling their assets to receive lower payment plans. <p>In Buffalo, debt collectors have been caught calling up debtors and saying that they are law enforcement. They have threatened to send debtors to prison, or even take child custody away from them. And it doesn&#8217;t stop there.</p>
<p>A recent civil case imposed a $675,000 penalty ever imposed on a debt collection business, for illegal and deceptive practices. This includes harassing and lying to consumers, cashing in on post dated checks early, and disclosing their debt to third parties. These tactics came by deceptive claims from agents saying they were lawyers or other figures of authority.</p>
<p>In addition to refusing to reveal the address or phone number of the &#8220;company&#8221; these agents even went as far as to call people who were not in any debt at all and attempted to collect money from them. Even though the owners of said companies alleged that it was individual workers acting fraudulently, the Federal Trade Commission went after the business owners and won a case that imposed the biggest penalty ever for debt collection agencies.</p>
<p>To skirt the issue of being a victim to fraudulent collection agencies, it is imperative that you know your rights. A collection company can never seize a debtor&#8217;s assets, bank accounts, or paychecks. They can not get a debtor fired from their occupation, and cannot make any kind of public disclosures concerning the debt, and they can definitely never threaten or engage in violent acts.</p>

The notices are for unpaid garbage fees that may have actually been paid. According to officials, the garbage bill itself for 2009 could be to blame for more than 200 collection notices sent to city taxpayers in error last week.</p>
<p>They think the issue might be the way the bills were folded into the envelopes. The bill comes with a perforated line above a bar code that identifies the customer, but because of a crease made by the folding of the envelope, a second line under the bar code was formed, which caused people to pull the bill off without the bar code.</p>
<p>Bills that didn&#8217;t have a bar code would cause a bank to not register the payment. The mailing house that Scranton hired to stuff the envelopes was fingered. If the bill was mailed to the bank, it would be the pay stub in their payment that goes straight into a lock box. The stubs are then scanned and the bar code is read. After that the bank sends the town a list of those who had come through based on the bar code readings.</p>
<p>Representatives from the debt collections agency who sent out the letters say that they are taking every dispute from people who might have already paid extremely seriously. Company protocol allows consumers to dispute a notice within 30 days of receiving a collections letter. In addition, representatives said that no bill will be collected while they are still sorting out the issue.</p>
<p>The agency will look into each claim from those who alleged they had paid the bill and gotten the notice. Those that they think have paid will be absolved from their debt and will no longer get collections notices and will not be pursued by the collection company.</p>

<p>Not all personal property can be taken. The defendant can file a Claim of Exemption to protect the &#8221; necessities of life,&#8221; possibly including a house, heirlooms, clothes and some wages.</p>
<p>The cost of a Writ of Execution &#8211; as well as the amount that the sheriff or marshal charges to deliver the writ &#8211; can be added to the amount that the defendant owes you. You also are entitled to interest during the time it takes to collect.</p>

<p>One very elaborate scheme to get the information on your debtor&#8217;s bank account is what I like to call &#8220;the fake block party.&#8221; Mail post cards to everyone who lives on your debtor&#8217;s block, and put up signs directing traffic towards his house. The debtor may get block party fever and open his garage. Scope out his items and take inventory. He may even start to sell things. At this point, buy something and give them a check.</p>
<p>So there you go. All of these schemes are legal, and legit. But my advice would be to look through trash and stage an elaborate block party last, because that seems kind of crazy.</p>

<p>Claiming that it is a way of ensuring medical providers get paid while also keeping administrative costs down, the company has been around since 2008. It operates like this: when they arrive at their doctors office, patients are told by their medical care provider what the maximum amount a particular procedure will be likely to cost. The patient uses their credit card, gets the procedure done, and walks out of the office with a receipt and a detailed slip of services provided.</p>
<p>At this point the provider will charge the patient&#8217;s insurance company. The insurance company will inform the provider how much of the work is covered; the balance remaining is charged on the card. If a deductible has not been met, then the entire price of the procedure is charged.</p>
<p>With the increase of health care costs, more pressure has been placed on patients to pay their bills in the form of co pays, out of pocket expenses, and higher deductibles. With this increasing stress, unpaid and delinquent bills have become big issues for medical providers.</p>
<p>Health care payments are now up to over three hundred billion dollars a year, and that number is supposed to balloon up to double that number by 2015. From this number, fifty to sixty billion dollars of current health care debts go into delinquency. The program has proven to reduce delinquent accounts by up to eighty percent.</p>
<p>But some analysts remain skeptical. The issue of patients who don&#8217;t pay off their balance each month hasn&#8217;t yet been resolved, much less the issue of a patient not having a credit card.</p>

<p>Collectors have to be careful to follow the Federal and State laws that apply because people&#8217;s financial problems are a sensitive issue. The Federal Trade Commission says that a collector must positively identify the person who owes money before they can announce that the purpose of the call is to collect debt.</p>
<p>Then, the debt collector will issue a statement, at times known as a &#8220;mini-Miranda&#8221; which tells the customer that they are in fact a collector.</p>
<p>Collectors also must follow the state laws that say how they must proceed. A lot of companies utilize electronic systems now to help bill collectors remember all of the laws and regulations regarding each call.</p>
<p>Debt collectors use computers and an assortment of automated systems in their jobs. Despite the fact that the majority of uninsured young adults are employed, a lot of uninsured young adults work in low wage jobs and for employers who offer limited or no health care coverage.</p>
<p>With this much young adults already struggling to pay everyday expenses, debt collectors should step back and take a look at this situation. Uninsured young adults are two times as likely as those with private insurance to have no education beyond high school. That limits their future earnings potential.</p>
<p>Because of the financial problems in 2008, stricter credit standards will most likely make it harder for a number of young adults to pay for post graduate education or get loans for &#8220;good debts,&#8221; such as a home.</p>
<p>This as well as the new problem of cell phones, makes it harder than ever for bill collectors to get into contact with consumers. John Monderine, owner of Rapid Recovery Solutions alleges that over 40 percent of his consumers don&#8217;t have landlines at this moment.</p>
<p>Researchers in the field expect more methodical profiling systems will be created to help debt collection companies in collecting those accounts where there is a cell phone active and information from bureaus to determine if the debtor has a new address or phone number.</p>
